City Of Chicago Files Suit Against Red Light Camera Company

The Chicago Tribune reported last month that the city of Chicago has filed a lawsuit asking for $300 million against Redflex, the red light camera company that profited due to a $2 million bribery scheme.

The 20-page lawsuit seeks triple the $124 million Redflex collected on the Chicago contract both before and after it was fired by Mayor Rahm Emanuel amid the scandal, as well as a civil penalty of up to $10,000 for each time the company made a false statement to the city. The lawsuit details an alleged conspiracy in which Redflex executives teamed up with former city official, John Bills, to orchestrate cash payments to him through a consultant acting as a bagman, as well as providing Bills with vacation trips, computers, golf outings and other perks. In exchange, according to the lawsuit, Bills coached Redflex on how to beat its competitors, orchestrated key votes at City Hall, manipulated field tests to favor the company, covered up problems with Redflex’s performance and cost taxpayers millions by encouraging city officials to buy Redflex cameras instead of leasing them.

“Had the City known that these statements were false, the City would have canceled the contracts with Redflex,” the suit alleges. “The City suffered damages in reliance of Redflex’s false statements that it had not engaged in bribery or attempted to bribe any employee of the City.”

The lawsuit is actually an intervention of an existing whistle-blower lawsuit filed by former Redflex executive Aaron Rosenberg, in Cook County Circuit Court last year.

I guess this is an attempt by the city to wipe some of the egg of their face as it was their own employee that was in the middle of the bribery scheme. How is it no one from city hall knew that this was going on at the time that the contracts for red light cameras were being bid on. I hope the city can recoup some of their money but this seems like too little too late for a program that has been drenched in controversy since day one. Not only was Redflex operating under fraudulent circumstances, but the entire purpose of the program has been called into question as it is not clear there is a safety benefit to red light cameras. I will be interested to learn what happens with this lawsuit.

Chicago’s Traffic Congestion Is Still Terrible

Both the Chicago Tribune and Crain’s reported last week that there are five (5) stretches of roads in the Chicago area that are ranked within the top twenty (2) most congested in the United States.

The results are based on a study conducted by the Texas A&M Transportation Institute called the Urban Mobility Scorecard. No. 4 nationally was I-90/94 westbound from 35th Street to the Edens junction. The eastbound stretch from Montrose Avenue to Ruble Street, just south of Roosevelt Road, ranked No. 7 nationally. No. 14 nationally was the Jane Addams Memorial Tollway (I-90) eastbound starting at the Tri-State Tollway (I-294) and extending to the Kennedy at the Edens (I-94) merge. The study concluded that the Chicago area ranked No. 8 overall for the nation’s worse traffic.

As I have discussed recently on this blog, a portion of the traffic problem (and the increase in Illinois traffic accidents) is that the economy has rebounded and there are more drivers on the road. “The national congestion recession is over,” the report concluded. “The total congestion problem is larger than the pre-recession levels.”

What does this mean for Chicago drivers and their commute times? A driver in the Chicago region who really needs to arrive on time at a destination that is 20 minutes away in light traffic should instead budget a full hour to get there during peak travel times, said Bill Eisele, a senior research engineer at the transportation institute and the report’s co-author.

What is the solution to this gridlock? The authors of this study believe that lawmakers must act aggressively to address the traffic issues before the problems get worse. Experts say possible enhancements include expanding roadway capacity, providing incentives for people to alter their travel times away from the 6 to 10 a.m. and 3 to 7 p.m. peak hours, and expanding public transit and attracting new riders with new services that include new rail lines and bus rapid transit, airport express trains and options directed at luring reverse commuters from their cars to trains and buses.

NASCAR Driver Tony Stewart Named In Wrongful Death Lawsuit

I wrote extensively last year about the fatal car crash involving Tony Stewart when his sprint car crashed into another driver who had exited his vehicle during the race. The sprint car race took place Canandaigua Motorsports Park on Aug. 9, 2014.

As many recall, a criminal investigation occurred following the fatal car accident and Mr. Stewart was absolved of any criminal wrongdoing, including negligent homicide, often referred to as manslaughter. Manslaughter charges can be sought when the crime does not rise to the level of an intentional act. Rather, the criminal act is based on some sort conscious disregard for others, which leads to another’s death. These types of charges are often brought in fatal drunk driving cases. Regardless, a grand jury was convened and they did not believe that Mr. Stewart’s actions were intentional or rose to the level of manslaughter. The grand jury concluded that Kevin Ward’s death was an accident.

Being cleared of criminal actions did not absolve Mr. Stewart from liability in civil court. The family of the deceased driver has filed a civil wrongful death lawsuit alleging Stewart of gross negligence, saying he gunned his engine and put his car into a skid as 20-year-old Kevin Ward Jr. walked onto the track after a crash at Canandaigua Motorsports Park on Aug. 9, 2014. The car struck Ward, and he was killed. The lawsuit notes Stewart’s reputation for having a temper and claims that Stewart deliberately veered toward Ward after the collision.

It will be interesting to see how far this case goes into litigation and whether the case actually goes to trial. Mr. Stewart’s legal team will no doubt argue that Mr. Ward was negligent himself by exiting his car and putting himself into harm’s way. If this case goes to the jury, I could see them concluding that Mr. Ward was at least partially at fault for stepping out into the track. The key will be whether the Ward family can prove that Mr. Stewart skidded intentionally and that was a negligent act considering he was so close to the other driver. Further, Ward’s family must show that the skidding action caused Mr. Stewart’s vehicle to fishtail and strike Mr. Ward.

Lyons Township High School Adding Traffic Light & Pedestrian Crossing

The Chicago Tribue reported this week that the town of Willow Springs has decided to add a traffic light and pedestrian crossing at Lyons Township high school located on Willow Springs Road.

Western Springs officials say the traffic light will make the area safer for motorists and pedestrians for both park and school traffic. A pedestrian crossing has also been installed at Mason Drive.

“It’s been a long time coming, and it is good to finally see this come to fruition,” said Village Trustee Sheila Hansen.

This isn’t the first safety initiative in Willow Springs recently. They have worked alongside the town of Lagrange to improve safety for drivers, pedestrians and bicyclists.

An intergovernmental agreement was signed by the two villages, the park and school districts back in November 2012 that outlined the need for the project. A traffic corridor study was also conducted from 47th Street to Adventist La Grange Hospital between the villages of La Grange, Western Springs and the school district at a shared cost of $18,500, La Grange officials said.

The total cost of the project was listed at $416,000 after bidding last fall, according to budget numbers from the village of La Grange, with $376,000 in federal Surface Transportation Program grant funding, and a $90,000 grant from the Illinois Department of Commerce and Economic Opportunity. The project includes reconfiguration of internal roadways and drop-off and pick-up procedures within the LTHS campus, alignment of the driveway entrances at Denning Park with the proposed signal at LTHS, installation of east-west sidewalk through Denning Park to connect to existing neighborhood sidewalk system, an enhanced crosswalk at Mason Drive and Willow Springs Road, and enhanced school speed zone signs with flashing yellow beacons, according to the proposal approved by the village of La Grange, the lead agency for the project.

It is good to see these suburban communities working together, which will hopefully prevent future accidents. I think it is interesting to see that this initiative did not include any talks about red light cameras or speed cameras that, as we all know, are scattered across Chicago.

New Bicycle Lanes Are Under Construction On Chicago’s Clybourn Ave

 

Multiple news outlets, including the Chicago Tribune, reported last month that the city began construction on a new stretch of dedicated bicycle lanes along Clybourn Avenue. The lanes will stretch from North Avenue to Division Street and from Division to Orleans. The Illinois Department of Transportation (IDOT) hopes the project will be completed by early August.

This is a welcome addition to Chicago bicycle enthusiasts as the number of bike commuters continues to grow. The Chicago Department of Transportation (CDOT) estimated recently that 38% of all morning commuters are bicyclists.

I think a tip of the hat needs to go to Mayor Emanuel and his staff as they continue to expand and promote bicycling in Chicago. The mayor vowed when he took office that Chicago would continue to grow and become one of the most bicycle friendly cities in the world. Part of this vow has been his commitment to safety. By adding these dedicated bicycle lanes allows a separate and (hopefully) safe space for bicyclists. Drivers must honor that space and stay in their own lane. Although I haven’t seen any statistics on bicycle accidents recently, I believe the city is safer and healthier with all of these new bike lanes. There are now fewer vehicles on the road during rush hour commutes (which is good for everyone) and bicyclists can safely commute to their jobs knowing they have their own dedicated lane. I look forward to see where the mayor continues to expand these lanes.

Chicago CTA Bus Driver Cited For Fatal Bus Crash

Multiple news outlets have reported about the Tuesday’s CTA bus crash in downtown Chicago that killed one pedestrian and seriously injuring seven others. The driver allegedly came to a stop at the red light at Lake Street while heading North on Michigan Avenue, then inexplicably, drove through the red light and ended up on the sidewalk after trying to avoid another vehicle. All of this led to the death of a woman and the multiple injuries.

The driver, who started his job with the CTA in September, was was issued two traffic citations for the crash. The driver  began his shift Tuesday at 6:20 a.m., driving the Clark Street #22 bus till 8:20 a.m., Chase said. His next shift began at 2:31 p.m. on the 152 Addison and 135 Clarendon/LaSalle routes before he started driving the 148 Clarendon/Michigan route at 5:27 p.m., about 20 minutes before the collision was reported.

The question (or elephant in the room) that needs to be answered is why in the world did the driver run that red light?  There are no red light cameras or speeder cameras at that intersection. It is possible that the camera from the bus could shed some light on the incident. Also, more than likely, there has to be surveillance cameras from the neighboring loop office buildings, including the mammoth Illinois Center. Regardless, the CTA will be seeing multiple lawsuits. One for wrongful death from the family of the deceased and the others for the personal injuries of those who survived the bus accident.

Illinois Senate Democrats Vote Down Rauner’s Worker’s Compensation Bill

Illinois Governor Rauner attempted to pass a new bill last week that would gut Illinois Workers Compensation Act. The Chicago Tribune reported that the Senate Democrats repeated the effort by their counterparts in the House as they blocked the bill at a Committee hearing.

At the Committee hearing opponents of the bill said the changes, which would toughen standards for an employee to prove an injury happened on the job and cut reimbursement rates for doctors who treat workers, could have “unintended consequences” in which doctors refuse to provide care. Instead, they said more time was needed to gauge savings from a 2011 rewrite of the workers’ compensation system. Democrats contended that Rauner is more concerned with the bottom line than ensuring workers are made whole.

“There seems to be a common corporate view of government here,” said Sen. Don Harmon, D-Oak Park. “You guys seem to always be worried about the next quarterly report … it’s a recurring theme.”

I applaud the Senate Democrats for standing strong against Rauner’s attempt to gut our Workers’ Compensation system in Illinois. What Rauner and his aids refuse to admit is that his changes would immediately affect hard working Illinoisans by limiting the availability to doctors (should they be hurt on the job) and also make it harder to recover benefits at all. He is clearly looking out for the bottom line for insurance companies and corporations.

Studies Show Summer Is Most Dangerous Time Of Year For Drivers

The Chicago Tribune published an interesting article last month about what we should expect this summer for on the highways in Illinois. Basically, the authors pointed out that that due to the increased number of expected travelers this summer, we should expect more car accidents and traffic fatalities than we saw in 2014. Going into Memorial Day weekend, Illinois already had 15 more traffic fatalities than the same time last year.

While vehicle fatalities have increased 5 percent in Illinois so far this year, motor vehicle deaths nationally increased 11 percent — to 8,250 fatalities — in the first three months of 2015, compared with the same period in 2014, according to an analysis by the National Safety Council, based on preliminary figures from the National Highway Traffic Safety Administration. The traffic safety administration’s official count includes only traffic deaths that occur within 30 days of accidents, whereas the safety council counts deaths that occur within a year of accidents.

Injuries resulting from car crashes in which medical care was received hit almost 1 million from January through March of this year in the U.S., a 26 percent increase from the same period in 2014, the safety council said.

The increase in crash-related deaths correlates to more vehicles on the roads, more total miles traveled and lower fuel prices, officials said.

The leading causes of traffic accidents continue to be intoxication and the use of cell phones. Despite most states, including Illinois, which have outlawed the use of cell phones while driver, not state has banned hands free usage.The National Traffic Safety Board (“NTSB”) and subsequently the the National Safety Council  have called for a ban on hands-free cellphone use of any kind, but no states have enacted laws completely prohibiting the use of mobile devices while driving. Illinois law permits the use of hands-free devices, except in construction zones.

Investigation Continues Following Deadly Amtrak Crash

It has been almost three weeks since the fatal Amtrak train accident in Philadelphia and the National Transportation Safety Board (“NTSB”) is still trying to find answers. First, the NTSB is investigating whether the conductor was on his cell phone at the time of the derailment. The agency says investigators are comparing time stamps from engineer Brandon Bostian’s phone records with locomotive data, radio transmissions and surveillance video to see whether the phone was used while the train was in motion. Phone records show the phone was used to make calls, sent text messages and access data the day of the derailment, but it’s unclear when.

The NTSB is also reviewing what Bostian was doing the day before the train crash to determine if fatigue was an issue.  The first leg of Bostian’s shift on May 12 was particularly grueling, union officials say, with equipment-related delays on his train to Washington shortening his rest break. A system displaying track signals on the dashboard failed, forcing Bostian to pay close attention while reducing speeds far below normal, according to Railroad Workers United. The train reached Washington 26 minutes late, leaving Bostian about an hour to rest, eat and use the restroom before his trip back to New York on the train that eventually derailed.

The NTSB is focusing all of its’ attention on Bostian at this point because he was alone at the controls at the time of the train accident.  There’s no explanation for why the train went from 70 mph about a minute before the crash to 106 mph a few seconds before it left the tracks. Investigators say preliminary inspections found no problems with the track, the signals or the locomotive. They’ve also ruled out a bullet causing a grapefruit-size fracture on the locomotive’s windshield and say they’re uncertain whether anything struck the train.

This is an investigation I will be following closely as there appears, at this point, nothing faulty with either the train or the track. The focus is on the conductor. Was he on his phone or distracted some other way? Did he pass out or faint or have a seizure right before the derailment? Something needs to explain why the train increased in speed so rapidly. The families of the deceased and the injured will want answers.  As do those who continue to ride Amtrak trains.

NTSB: Amtrak Train Sped Up Before Curve; Trying To Determine Why

National Transportation Safety Board (“NTSB”) is trying to answer questions in the aftermath of the derailment in Philadelphia this week that killed 8 and injured hundreds others.  What we do know, according to NTSB board member Robert Sumwalt, In the minute or so before the train crash, the train sped up from 70 mph until it reached more than 100 mph at a sharp bend where the maximum speed is supposed to be 50 mph. It’s unclear, Sumwalt said, whether the speed was increased manually by engineer Brandon Bostian. Investigators have found no problems with the track, signals or locomotive. Sumwalt said the train, on a route from Washington to New York City, was on time as it left the station in Philadelphia a few minutes before the crash.

Mr. Bostian, who is recovering from multiple injures after the train crash, stated that he does not recall anything from the time of the accident. He has refused to speak to police at this point, but did agree to a meeting with the NTSB, which will take place in the next few days.

I think it’s clear, at least from the early investigation, that the conductor negligently drove the train up to 50 mph over the speed limit. This is what appears to be the cause of the train derailment. The question remains whether the conductor did this accidentally, was he distracted or was there a malfunction with the equipment? These are answers the NTSB, the victims and the family of the deceased all want. I will be following this case closely in the coming days and weeks.
