GM Recalls Close To 500,000 Trucks

The National Highway Traffic Safety Administration (“NHTSA”) announed this week that General Motors is recalling 461,000 trucks and SUVs based on a transmission issue. The vehicles recalled include the 2020-2022 Chevrolet Silverado, GMC Sierra, 2021 Cadillac Escalade, Chevrolet Tahoe and GMC Yukon.

The specific auto defect involves a transmission control valve on the impacted vehicles may fail causing the rear wheels to lock up, the NHTSA said, which would increase the risk of a crash.

GM dealers will install a new transmission control module software free of charge and GM will provide a special coverage program for repairing transmissions identified as containing a defective control valve.

GMC Recalls SUV And Pick Up Trucks For Brake Fluid Defect

The National Highway Traffic Safety Administration (“NHTSA”) announced this week that GMC will be recalling approximately 450,000 SUVs and Trucks due to an electronic brake control module software that could fail to display a warning light when a loss of brake fluid takes place.

The recall includes 2023-2024 Cadillac Escalade and Escalade ESVs, 2023 Chevrolet Silverado 1500, 2023-2024 Chevrolet Tahoe and Suburban 1500, 2023 GMC Sierra 1500, 2023-2024 GMC Yukon and Yukon XL,

GMC stated that the recall will include a free software update, which will hopefully eliminate the defect.

The NHTSA stated th a vehicle may be driven with low brake fluid if they aren’t provided the warning, which can reduce braking performance and increase the risk of a crash.

Toyota Recalls Popular Highlander SUV

According to The National Highway Traffic Safety Administration (“NHTSA”), Toyota recalled their Grand Highlander SUV and Lexus TX due to an airbag defect. Specifically, the driver’s side curtain airbag might not deploy during a crash, increasing the chance of an injury. Toyota annunced that it will notify owners once a solution has been found.

The recall is for approximately 145,000 vehicles. In a press release Toyota stated that the affected airbags are located on the driver’s side, and the deployment problem might occur if the driver’s window is rolled down. Obviously, that could increase the risk of an injury during a crash that involves that area.

The recall was announced at the end of July and I have not seen that there has been a reslution to fix the defect. Nor have a seen any news that there have been any serious car accident injuries for traffic fatalaties due to this defect. Ford Motors Recalls 1.5 Million Vehicles For Defects

Earlier this week Ford Motor Company announced to that they would be recalling almost 1.5 million Lincoln and Ford vehicles. The main culprit appears to be the 2011 – 2013 F-150 trucks that contain 6 speed transmissions. According to press releases, the faulty downshift to first gear has caused 5 accidents thus far. Approximately 1.48 million F-150 vehicles will be recalled

Ford spokespeople stated: ” Depending on vehicle speed, a downshift to first gear without warning could result in a loss of vehicle control, increasing the risk of a crash.” Ford is also recalling 27,000 2017 to 2019 Lincoln Continental vehicles , and 4,200 2019 Ford Mustangs silicon contamination in the door latch, which can prevent it from fully engaging.

It is important to point out that auto accidents caused by auto defects are completely different than your normal car accident caused by another driver’s negligence. If the evidence shows that a car crash was caused by a defect in the vehicle (as described above in the F-150 trucks), then the injured party can make a claim or ultimately file a lawsuit based on the auto defect. Jeep Cherokee And Ford Explorer Receive Worst Grades On Crash Test

Multiple news outlets reported this week that the Insurance Institute for Highway Safety performed crash tests on eight (8) different SUV vehicles. The crash test mimics what would be considered a violent and dangerous type of collision. Of all the vehicles tested, the Jeep Cherokee and the Ford Explorer were the only vehicles to receive a “poor” rating.

In the test, a vehicle is propelled at 40 miles an hour and strikes a barrier with just the outermost part of the bumper on the passenger’s side. It is designed to mimic the impact of a vehicle with another car or a tree or pole with just the outer part of the bumper. The occupant compartment on the Grand Cherokee was also crushed inward in the test. The crash test dummy’s head sunk into the front airbag so far that it hit the dashboard. Also, the side airbag failed to deploy while driver’s side door also opened. That allowed the dummy’s head to move outside the vehicle. Leg injuries were seen as likely and head injuries possible.

In a response email, Ford stated: “In an email, Ford said that the Explorer is safe, and has earned top scores in all other crash tests. The automaker added that a new version of the Explorer will go on sale next year, and that it expects that car will earn top scores in all Insurance Institute and government crash tests, including the small overlap test.”

What does this mean for both of these car makers? For one, I think it opens the door for auto defect lawsuits if serious injuries result from these types of crashes. In most jurisdictions (states), there are two (2) types of auto defect claims. The first is an auto product liability case, which arises when a car defect causes the accident which results in serious injury or death.  These types of auto defects are referred to as crash causing defects.  An example of a crash causing auto defect is the tread separation of a defective tire which results in the driver losing control of the vehicle.

The second type of auto defect case arises when a vehicle fails to provide reasonable crash protection to its occupants.  This type of case is often referred to as a crash worthiness case.

For the above vehicles, if there are cases where drivers are seriously injured in violent crashes as described above, I think we could see a rise in crash worthiness auto defect lawsuits against both car makers.

Self-Driving Tesla Involved in Fatal Traffic Accident

 

Self driving cars are the wave of the future. That is what you will hear from the people at Google and electric car manufacturer, Tesla. Manufacturers state that the technology is foolproof and completely safe. Unfortunately, this may not be true as of yet. News hit the wires over the weekend that a motorist whose Tesla vehicle was on autopilot while driving in Florida, was involved in a fatal car crash with semi tractor trailer.  According to news reports On May 7th at 3:40 p.m. on U.S. in Williston, Florida, 45-year-old Joshua Brown was killed when his Tesla Model S went under the trailer of an 18-wheel semi and the roof of his car was torn off by the impact.

According to Tesla’s press release, this is their assessment of what happened:

“Autopilot engaged when a tractor trailer drove across the highway perpendicular to the Model S. Neither Autopilot nor the driver noticed the white side of the tractor trailer against a brightly lit sky, so the brake was not applied. The high ride height of the trailer combined with its positioning across the road and the extremely rare circumstances of the impact caused the Model S to pass under the trailer, with the bottom of the trailer impacting the windshield of the Model S.”

Tesla CEO Elon Musk also responded fatal traffic accident on twitter. He stated that the Tesla’s radar did not detect the truck because of its height, and thus the radar probably confused it with an overhead traffic sign.

This is obviously a sad and tragic event. But it also proves that self driving cars are not immune to car accidents, let alone traffic fatalities. The National Highway Traffic Safety Administration is currently investigating the accident. How does this event affect the family and/or estate of the deceased driver? Well, if it is found that the truck was at fault for negligently pulling out in front of the deceased, then the truck driver could be held accountable in a normal negligence and wrongful death cause of action. The family could also sue Tesla under a product liability or auto defect count. Their attorneys could plead and argue (with expert testimony) that Tesla’s safety system was defectively designed and built because it could not properly detect the difference between a truck and an overhead highway traffic sign.

Regardless, I believe it is fair to say the self driving vehicles are not completely safe and there may need to be modifications as the technology moves forward.

More Faulty Takata Airbags Force 5 Million Additional Vehicle Recalls

Multiple media outlets reported recently that based on Takata Company’s faulty airbags, 5 million vehicles are being recalled in the world wide (approximately 2 million  in the U.S.). Allegedly moisture can get inside its air bag control computers, causing the power supplies to corrode and fail. If that happens, air bags may not inflate in a crash or they could deploy without a crash.

This recent recall for Takata comes on top of recent 24 million vehicle recall for their faulty airbag inflator. Takata’s inflators can explode with too much force, blowing apart a metal canister and sending shrapnel into the passenger compartment. At least 11 people have died worldwide from the problem, and 139 injured. This previous recall is the largest of its’ kind in U.S. history. The U.S. safety investigation began in August after NHTSA found 19 complaints from drivers that air bags didn’t inflate in crashes of older Honda Accords.

The automakers affected by the recall include Honda, Toyota, Fiat Chrysler, Volkswagen, Mercedes, Mazda and Volvo. I highly recommend doing your own search to see if your vehicle’s air bag needs to be replaced.

Takata and the auto makers are no doubt facing numerous auto defect and product liability lawsuits for injuries.  They will also be facing class action lawsuits for the auto defect based on the loss of value the auto owners will see in their vehicles.

Ford Orders Recall Based On Door Latch And Seat Belt Defects

It was reported this week that Ford Motor Company has recalled 205,000 of its’ 2010 to 2013 model Taurus vehicles based on a door latch issue.

Ford says a door latch spring can become unseated, allowing the door to unlatch in a side-impact crash. The company says it knows of no injuries from the problem. Dealers will inspect the latches and replace door handles if needed.

The second recall covers just over 16,000 Transit Connect small vans in the U.S. from the 2014 model year. Seat belt fasteners can loosen, causing the belts to malfunction.

It has not been reported that either of these auto defects have caused in any injuries from auto accidents.
