This is a website that offers advice about maximizing travel reward point, but also like to give overall travel tips and advise. First is their to do list regarding vehicle safety:

  • Your vehicle has been inspected by a qualified mechanic.  Check your tires, battery, belts, fluids, air conditioner, engine, brakes and windshield wipers.
  • The spare tire is in good condition.
  • You have a gallon of antifreeze
  • To bring an empty 1-gallon gas container.  Although let’s face it… the type of person who completely runs out of gas is usually not the type of person who reads these kinds of articles on preparation.  So share this with that one friend you have!   Also, NEVER carry gasoline in your car.
  • To bring a back-up battery for your mobile phone and/or a car charger
  • To have plenty of drinking water, sunscreen, and other items to keep your body healthy
  • To have a paper map in case you don’t have power.  Or at least download maps to your phone in case you don’t have reliable cell service throughout the entire trip
  • You bring your driver’s license and registration, copy of car insurance policy and contact numbers, car’s manual

Second is a safety checklist of items to carry with you, no matter how short you getaway may be:

  • First-aid kit with your prescription drugs, pain relievers, antiseptic, bandages, scissors, medical tape, motion sickness medicine
  • Road flares
  • Extra bottles of drinking water — gallons would be great
  • Rain ponchos / Umbrellas
  • Fully-charged car jump-starter (I have one of these gizmos.  It’s clutch when you can’t find someone to jump your car.)
  • Jumper cables
  • Flashlights with extra batteries
  • Blankets, pillows, or sleeping bags
  • Warm clothes if it’s cold
  • Snacks / food / energy bars
  • Diapers / baby supplies
  • Sanitary pads
  • Hand sanitizer
  • Toilet paper
  • Toothbrushes and toothpaste
  • Bug spray
  • Fire extinguisher
  • Cash
  • And your credit card that gives your professional roadside assistance

Chicago To Add Five New Speeder Cameras This Summer

The Chicago Department of Transportation (“CDOT”) announced last week that they would be adding five (5) new speeder cameras around the city by the end of the summer. Two (2) of the cameras will be placed at Hiawatha and Kosciuszko parks on the Northwest Side. The other three (3) cameras will be placed near Major Hector P. Garcia MD High School on the Southwest Side, Near North Montessori School on the Near Northwest Side and Gary Comer College Prep High School on the South Side.

CDOT told the Chicago Tribune that ““Automated speed enforcement is a proven deterrent to speeding, and one of the most effective tools in our toolbox for reducing speeding and saving lives.” They further pointed out that this was another step in Mayor Emanuel’s “Vision Zero” plan, which is aimed at eliminating all traffic accident deaths by the year 2026.

I have written on the site multiple times about red light and speed cameras. Based on multiple studies (and a bribery scandal), the red light cameras have come under a lot of scrutiny for any safety value added to the community. On the other hand, speeder cameras, have not undergone as much scrutiny. For one, they are newer to Chicago and we don’t know the actual net impact they are providing for motorists and pedestrian safety. According to CDOT, safety cameras are actually making streets and walkways safer throughout the city. According to the Department the number of speeding violations has been trending down in areas with speed cameras since they were deployed in 2014, and average traffic speed has dropped from 26 mph to 22.5 mph. Crash data also show that the number of car crashes in areas with speed cameras was down 4 percent in 2015 compared to 2013, while for the rest of the city crashes were up 13 percent.

Traffic Light Funding Approved For Deadly Stretch Of Devon Ave

NBC 5 reported last month that funding for a new traffic light has finally been approved on Devon Avenue near Le Mai Street in Chicago’s West Rogers Park neighborhood. This stretch of Devon has dubbed “Devon Speedway” by local residents as drivers are known to zoom by at rates of 60 mph despite a speed limit of 30. The funding finally came to fruition after a young man was rear-ended on his motorcycle and killed last month. This was one of multiple deadly traffic accidents in this area over the last several years. 39th Ward Alderman Margaret Laurino informed news outlets after this last car crash that funding had been had finally been approved for a new traffic light.

It’s a shame that it has taken the city this long to approve a traffic light that was obviously needed years ago. According to this report, a study was supposed to have been performed by the city’s department of transportation (CDOT) back in 2013. The family of deceased motorcycle driver will more than likely file a wrongful death lawsuit against the driver who rear-ended him. I think there is also potential to name the city of Chicago in this lawsuit. Government entities typically have immunity to lawsuits involving negligence unless the entity had notice of the issue (here lack of traffic light) and failed to address the issue. Here the deceased’s family could argue that the city knew as far back as 2013 that this stretch of Devon Avenue was incredibly dangerous and there had been requests for a traffic light, yet they waited five (5) years and after the most recent car accident death to provide the appropriate funding.

Jeep Cherokee And Ford Explorer Receive Worst Grades On Crash Test

Multiple news outlets reported this week that the Insurance Institute for Highway Safety performed crash tests on eight (8) different SUV vehicles. The crash test mimics what would be considered a violent and dangerous type of collision. Of all the vehicles tested, the Jeep Cherokee and the Ford Explorer were the only vehicles to receive a “poor” rating.

In the test, a vehicle is propelled at 40 miles an hour and strikes a barrier with just the outermost part of the bumper on the passenger’s side. It is designed to mimic the impact of a vehicle with another car or a tree or pole with just the outer part of the bumper. The occupant compartment on the Grand Cherokee was also crushed inward in the test. The crash test dummy’s head sunk into the front airbag so far that it hit the dashboard. Also, the side airbag failed to deploy while driver’s side door also opened. That allowed the dummy’s head to move outside the vehicle. Leg injuries were seen as likely and head injuries possible.

In a response email, Ford stated: “In an email, Ford said that the Explorer is safe, and has earned top scores in all other crash tests. The automaker added that a new version of the Explorer will go on sale next year, and that it expects that car will earn top scores in all Insurance Institute and government crash tests, including the small overlap test.”

What does this mean for both of these car makers? For one, I think it opens the door for auto defect lawsuits if serious injuries result from these types of crashes. In most jurisdictions (states), there are two (2) types of auto defect claims. The first is an auto product liability case, which arises when a car defect causes the accident which results in serious injury or death.  These types of auto defects are referred to as crash causing defects.  An example of a crash causing auto defect is the tread separation of a defective tire which results in the driver losing control of the vehicle.

The second type of auto defect case arises when a vehicle fails to provide reasonable crash protection to its occupants.  This type of case is often referred to as a crash worthiness case.

For the above vehicles, if there are cases where drivers are seriously injured in violent crashes as described above, I think we could see a rise in crash worthiness auto defect lawsuits against both car makers.

Apple Introducing App To Curb Smart Phone Addiction

CBS News reported this week that Apple is introducing a new app to help people that may be addicted to – – yes this is correct – – their own telephone. The new app will allow users to set limits on the phone in general, or choose to set limits for certain apps, such as social media. When the limit is reached, the device will shut down. Those who choose to use this new feature can also sync the monitor limits among devices, so you can’t switch over and keep surfing on your iPad or Macbook. Google also announced plans to help monitor smartphone use on Android devices.

Full disclosure, if my wife reads this I’m certain she will ask me to download this app immediately and ask me to apply it toward my Twitter usage. Regardless, this will be interesting technology that car makers and lawmakers to look at regarding phone use in vehicles. With the epidemic of distracted driving traffic accidents occurring in our country, I wonder if this type of technology could be used to prevent hand held phone use for drivers. Currently, laws banning cell phone use while driving is not preventing the number of car accidents around the country.

Memorial Day Weekend Is One Of The Busiest Traffic Weekends Of The Year

Next to Thanksgiving, Memorial Day is one of the busiest travel weekends of the year. According to AAA auto club close to 42 million Americans plan to take travel over Memorial Day weekend. This is a five (5) percent increase from last year.

In Illinois 2.04 million people plan to travel, which is an increase of four percent from 2017. Unfortunately, we will also see some of the highest gas prices in several years. It is estimated that the Illinois average for a gallon of gas is $2.95 is up from $2.70 last month, and $2.39 last year.

Based on past numbers, AAA expects to help approximately 340,000 motorists over the weekend.

This Friday, May 25, between 4:00 pm and 6:00 pm is supposed to be the busiest travel period over the weekend.

A few tips to ensure you have a safe road trip:

  1. Check your battery before heading out on an extended road trip.
  2. Check alternate routes and times for leaving so as to avoid the heaviest traffic
  3. Buckle up. Not only for safety purposes, but also, state troopers will be out in full force ticketing speeders and those no wearing their seat belts.
  4. Put the phone aside. For everyone’s safety, put your phone aside and stick with the hands free technology. This is always the safest way, but especially true when there are so many people out on the road.

National Construction Work Zone Awareness Week Included Chicago Event

Illinois Department of Transportation Secretary Randy Blankenhorn, who spoke at a National Work Zone Awareness Week event in Chicago last month stated: “Slow down, put the phone down, pay attention to your surroundings… you could save a life and more than likely it will be your own, as 4 out of 5 work zone fatalities are not our workers but drivers traveling through work zones.”

The Chicago Tribune reported recently that construction zone traffic fatalities have risen nationally, but fortunately, decreased in Illinois last year. There were 44 and 46 Illinois construction zone deaths in 2015 and 2016, but only 29 in 2017. Nationally there were 765 in 2016, a 7 percent increase from 2015.

The Illinois Department of Transportation (IDOT) is touting efforts made with law enforcement to help make construction zones safer as the reason for the improvements. Specifically, IDOT has been working with the Illinois State Police to help improve safety by cracking down on speeders and distracted drivers within construction zones.

Nationally, the excuses for the increase in deaths appear to be the same. Paul Pisano, team leader for road weather and work zone management for the Federal Highway Administration blamed the increase in traffic deaths to there being on the road, distracted driving and the amount of construction work being done.

Hopefully other states, and the federal government, can take a look at Illinois, and the efforts made with law enforcement to help improve safety in construction zones nationwide.  Illinois is far from perfect when it comes to traffic safety as there have been increases in pedestrian deaths in recent years. But hopefully the improvements seen in construction zones can be applied to all areas of traffic safety.

Tesla Driver Recreates Fatal Autopilot Accident

It was reported in multiple news outlets that an owner of Tesla Model X, crashed into a concrete barrier and died  last month in Mountain View, California. The vehicle was in autopilot at the time of the accident.  According to reports, the vehicle had the choice to veer right or left, did not break, and the autopilot sensors did not detect the concrete block, causing the fatal accident.

The National Traffic Safety Board (NTSB) is investigating the accident. Tesla, release the following statement regarding this fatal car crash:

“The driver had received several visual and one audible hands-on warning earlier in the drive and the driver’s hands were not detected on the wheel for six seconds prior to the collision,” Tesla wrote. “The driver had about five seconds and 150 meters of unobstructed view of the concrete divider with the crushed crash attenuator, but the vehicle logs show that no action was taken.”

Essentially, Tesla is attempting to put the blame back on the driver.

I think it is fair for us to conclude that this is not a true “autopilot.” The driver still needs to be aware as what is going on and be on alert as to any warnings that may come. Further, I don’t believe Tesla’s software still has flaws as do other self-driving vehicles, or we wouldn’t continue to see these fatal traffic accidents.

The litigation that is coming our way with these car accidents is going to be very expensive. There is no doubt in my mind that this will all be very expensive litigation, in part, due to the expert testimony that will be required to try to prove that Tesla’s software systems are faulty . Second, there will be lawsuits and cross-claims between parties as none of the parties involved or their insurers are going to want to take responsibility for the fatalities.  This will be on top of the normal lawsuits against the individual driver, who most likely holds an individual auto policy. This is going to lead to a lot of finger pointing and litigation. I will be interested to see what the NTSB concludes, and will be following this closely.

Uber Self-Driving Vehicle Leads To Pedestrian Death

Multiple news outlets have reported that a self-driving Uber vehicle, struck and killed a female pedestrian in Tempe, Arizona on Saturday night. Immediately following the news of this tragic traffic fatality, Uber  suspended all road-testing of such autos in the Phoenix area, Pittsburgh, San Francisco and Toronto.

The vehicle in question was a Volvo, which  was in self-driving mode with a human backup driver at the wheel when it hit 49-year-old woman as she was walking a bicycle outside the lines of a crosswalk, police said. The National Transportation Safety Board, and the National Highway Traffic Safety Administration are both investigating the accident.

At this point, it’s unclear who was at fault for this traffic accident. I have a lot of questions though, as this is not the first car crash or traffic fatality involving self-driving cars. First, what in the world was the human, “back up” driver doing at the time of the accident? If the vehicle’s cameras didn’t pick up the pedestrian, then the back up human should have been paying attention and stepped on the brakes or swerved the vehicle herself. Otherwise, what is the point of having a back-up driver in the vehicle. Also, self-driving car proponents continue to tout the safety benefits of these vehicles (i.e. they don’t get drunk, fall asleep or read phones), yet we continue to see accidents. I will continue to follow this story to see how Uber and other companies react and whether the federal government intervenes at some point to implement their own regulations.
